Complete Sales Terms

1. Commitment of Østlandet Brukt & Antikk AS

Østlandet Brukt & Antikk AS commits to selling items submitted by the seller at auction according to the terms below. Østlandet Brukt & Antikk has the right to sell submitted items at a time deemed most advantageous or appropriate.

1. Submission

2.1 The seller must have full ownership of the item submitted for sale or have written documentation of the right to sell it if owned by a third party.

2.2 Østlandet Brukt & Antikk is not obligated to verify the seller's right to sell the item without specific reason.

2.3 Upon acceptance of the sales assignment, a written/digital sales agreement shall be established.

2.4 Østlandet Brukt & Antikk may withdraw from the assignment if there is doubt about the authenticity, ownership, or other material information.

2.5 The seller is obligated to inform about known defects and shortcomings of the item.

2.6 Withdrawal of the sales assignment must be made in writing, at least three days before the item begins to be displayed to the public. The seller must compensate for handling costs if the sales assignment is withdrawn.

2.7 Transportation of items to and from Østlandet Brukt & Antikk is at the seller's expense and risk.

1. Cataloging

3.1 Østlandet Brukt & Antikk determines how items should be described and depicted.

3.2 All photographs and representations are owned by Østlandet Brukt & Antikk and may be used for other purposes without compensation.

3.3 The starting price is a market-adjusted estimate and serves only as a guideline.

1. Sales Fees

4.1 A commission of 20% including VAT of the hammer price and a fixed fee of 80 Norwegian kroner will be charged upon sale.

1. Storage and Insurance

5.1 Items are insured against damage from the time of receipt, to a value corresponding to the starting price minus fees, unless otherwise agreed.

5.2 Østlandet Brukt & Antikk is responsible for the safe storage of items.

5.3 Østlandet Brukt & Antikk is not responsible for damage to painting glass, frames, or natural changes in materials.

5.4 Østlandet Brukt & Antikk's liability is limited to the insurance value.

1. Monitoring

6.1 Østlandet Brukt & Antikk monitors that items are not sold below the acceptance price.

6.2 If the acceptance price is not reached, the item will be returned to the seller.

6.3 Østlandet Brukt & Antikk may sell below the acceptance price if the seller receives the same amount as if the acceptance price had been reached.

1. Accounting

The seller will receive a written account of the auction results after the auction.

1. Payout

8.1 Payout will occur no later than 30 days after the end of the auction, provided that full payment has been received and no complaints, rescissions, or right of withdrawal have been exercised.

8.2 Received payments are kept separate in a client account.

8.3 In case of exercising the right of withdrawal, the sale is rescinded, and the item will be listed for sale again.

8.4 If payment has not been received or a complaint has arisen, the sale is rescinded.

8.5 Østlandet Brukt & Antikk has the right to offset outstanding debts before payout.

1. Unsold Items

9.1 Østlandet Brukt & Antikk has the right to resell the item at auction without prior notice.

9.2 If the item is not collected, it may be donated to charity or sold at a reduced price.

9.3 Østlandet Brukt & Antikk may retain unsold items as security for the seller's debts.

9.4 If the item is not collected, Østlandet Brukt & Antikk may send the item to storage or sell it at the seller's expense.

1. Liability for Errors

If Østlandet Brukt & Antikk is held liable for errors in sold items, they may claim compensation from the seller equivalent to the compensation paid to the buyer.

1. Personal Data, Money Laundering, etc.

11.1 Personal data is used for administration and fulfillment of Østlandet Brukt & Antikk's obligations, market analysis, and marketing.

11.2 Information may be supplemented from private and public registers.

11.3 Information may be shared with partners.

11.4 Østlandet Brukt & Antikk complies with the law on measures against money laundering and terrorist financing.

11.5 The seller has the right to access recorded information and may request correction or deletion.

1. Force Majeure

Østlandet Brukt & Antikk is exempt from liability for failure to fulfill obligations due to force majeure. The seller may terminate the agreement if fulfillment is delayed by more than three months.
