Complete Purchase Terms and Conditions

1. BIDDING

1.1 Participation in bidding requires a customer number and password, which are provided upon application. Bids placed are binding.

1.2 The buyer is the one who has placed the highest accepted bid at the end of the auction. If two bidders have placed identical bids, the first bid submitted is the winning bid.

2. COMMISSION BIDDING

2.1 Participation in bidding can also occur through the submission of commission bids, which must be submitted in writing to Østlandet Brukt & Antikk.

2.2 Upon submission of a commission bid, identification must be presented. Østlandet Brukt & Antikk reserves the right to disregard commission bids if the bidder is deemed not to have the financial capacity for the submitted bid.

2.3 Østlandet Brukt & Antikk treats commission bids confidentially and will bid on behalf of the bidder as advantageously as possible.

2.4 The buyer is the one who has placed the highest bid at the end of the auction. If two bidders have placed identical bids, the first bid submitted is the winning bid.

2.5 Østlandet Brukt & Antikk is not responsible for damages that may occur to the bidder if Østlandet Brukt & Antikk fails to execute a commission bid.

2.6 The bidder is responsible for purchases registered based on an unclear or incorrect commission bid.

3. STARTING PRICE

The starting price of an item is based on a market-adjusted assessment conducted by Østlandet Brukt & Antikk. The starting price serves only as a guideline, and the price for which an item is sold may significantly differ from the starting price.

4. FEES ON PURCHASES

4.1 A bidding fee of 25% including VAT will be added to the final bid amount for each auction item.

5. RESULTS

5.1 It is the buyer's responsibility to check if commission bids have resulted in a purchase.

5.2 After the auction, the buyer will receive a confirmation of the purchase, either via email or mail, or the confirmation and invoice will be available under "My Pages."

6. PAYMENT

6.1 Payment can be made to our bank account 2801 54 64323. Please provide your customer number with the payment. Payment can also be made by card on the website or at our premises. We do not accept American Express or cash. Payment must be made within 7 days after the auction.

6.2 If payment is not made on time according to section 6.1, Østlandet Brukt & Antikk has the right to take one or more of the following actions:

(i) Cancel the purchase.

(ii) Demand payment.

(iii) Charge a reminder fee of 50 NOK.

(iv) Charge a late fee of 2% per month.

(v) Resell the item at the buyer's expense without special notice to the buyer.

Østlandet Brukt & Antikk has full and unrestricted rights to determine the starting price and whether the item will have a minimum price.

Østlandet Brukt & Antikk has the right to claim compensation for all claims Østlandet Brukt & Antikk has against the buyer from incoming amounts.

7. PICKUP

7.1 Purchased items can be picked up as soon as full payment has been made and received by Østlandet Brukt & Antikk. Items must be picked up within 7 days after the auction.

7.2 For items not picked up in time according to section 7.1, a storage fee of 50 NOK including VAT per auction item per calendar day will be charged.

7.3 Østlandet Brukt & Antikk's responsibility for storing items ceases if pickup does not occur in time according to section 7.1.

7.4 For items not picked up within 7 days after the auction, Østlandet Brukt & Antikk has the right to implement the following measures:

(i) Send the item to storage with a chosen shipping company. All transport and storage costs will be charged to the buyer.

(ii) Resell the item at the buyer's expense without special notice to the buyer.

Østlandet Brukt & Antikk has full and unrestricted rights to determine the starting price and whether the item will have a minimum price.

Østlandet Brukt & Antikk has the right to claim compensation for all claims Østlandet Brukt & Antikk has against the buyer from incoming amounts.

7.5 All transportation of items to the buyer is at the buyer's expense and risk. Transportation fees will be charged according to the current price list.

8. LIABILITY FOR ERRORS

8.1 All items are sold as is. It is the buyer's responsibility to inspect the item before the auction to assess the item's condition and quality. Østlandet Brukt & Antikk is not, under any circumstances, responsible for normal wear and tear, minor damages and defects, any tightening of canvas, the condition of frames, natural changes in living materials such as fading of paper and cracks in wood.

8.2 Clocks and timepieces are sold as art objects, and Østlandet Brukt & Antikk is not responsible for their technical function as timers. Østlandet Brukt & Antikk does not guarantee the function of mechanical or electrically/battery-operated items.

8.3 Information provided about, for example, the creator, authenticity, age, technique, provenance, or condition, is only guidance for the buyer during their inspection of the item. Østlandet Brukt & Antikk is not responsible for inaccuracies unless the incorrect information is provided with gross negligence.

8.4 Images of items are for identification purposes only. Østlandet Brukt & Antikk is not responsible for damages or defects not evident from such images.

8.5 Items are sold according to the provided description. Østlandet Brukt & Antikk reserves the right to change such descriptions, and any changes will be specified separately.

8.6 Østlandet Brukt & Antikk has the right to rectify errors in sold items for which Østlandet Brukt & Antikk is responsible. If rectification does not occur within a reasonable time from when a complaint about the error is raised, the buyer has the right to cancel the purchase and, upon return of the item, receive a refund of the amount paid to Østlandet Brukt & Antikk at the time of purchase. The buyer is not entitled to any further compensation.

8.7 Any errors must be reported immediately after the buyer discovers or should have discovered the error, but no later than 7 days after the auction date. Complaints regarding information about the creator, as specified in section 8.3, must, however, be made no later than 3 years from the date of purchase.

8.8 Østlandet Brukt & Antikk's liability for errors is limited to what is specified in these terms.

8.9 Østlandet Brukt & Antikk does not guarantee that the services on https://www.ostlandet.no are available at all times. Østlandet Brukt & Antikk is not responsible for any inconvenience or financial consequences suffered by customers due to the bidding function or other features being unavailable at all times.

9. RIGHT OF WITHDRAWAL

9.1 Buyers who are consumers have the right of withdrawal for distance sales and sales outside a fixed retail location. Exceptions to the right of withdrawal as stated in the aforementioned law apply fully to purchases.

9.2 The purchase must be withdrawn within the withdrawal period, which is a period of 14 days from the day the buyer receives the purchased item in their possession. Notification of the withdrawal must be given to Østlandet Brukt & Antikk in writing via email or letter within the withdrawal period. The easiest way to do this is by sending an email to obaskien@gmail.com.

10. DELIVERY DELAY

10.1 If there is a delivery delay caused by circumstances for which Østlandet Brukt & Antikk is responsible, lasting more than 20 working days and of substantial significance to the buyer, and Østlandet Brukt & Antikk should have recognized this, the buyer has the right to cancel the purchase with written notice to Østlandet Brukt & Antikk and receive a refund of the amount paid to Østlandet Brukt & Antikk at the time of purchase. The buyer is not entitled to any further compensation.

10.2 Østlandet Brukt & Antikk's liability for delays is limited to what is stated in these terms.

11. FORCE MAJEURE

Østlandet Brukt & Antikk is exempt from the consequences of failing to fulfill certain obligations under this agreement if the failure is due to circumstances of the type mentioned below, and the circumstances prevent or significantly hinder timely fulfillment. Circumstances considered as force majeure include, but are not limited to, acts of war, currency restrictions, shortages of transport, fire, government actions, changes in legislation, labor disputes, general shortages of goods, restrictions on power, accidents, or similar circumstances. If Østlandet Brukt & Antikk's fulfillment of certain obligations is delayed by more than three months due to force majeure circumstances, the buyer has the right to cancel the purchase in writing without liability for damages.

12. DISPUTES

Disputes regarding these terms shall be settled according to Swedish law in a court in Norway.
